TRADELINK — CUSTOMER TERMS & CONDITIONS
These Terms & Conditions ("Agreement") are a legally binding agreement between you ("Customer") and TradeLink Ireland Limited ("TradeLink", "we", "us"). By creating a customer account, you confirm you are at least 18 years old and agree to be bound by this Agreement in full.
1. About TradeLink
1.1 TradeLink operates a technology platform connecting customers with independent tradespeople in Ireland for home and commercial services.
1.2 TradeLink acts solely as a facilitator of introductions. We are not a party to any contract for services formed between you and a tradesperson, and we are not responsible for the services they deliver.
1.3 Tradespeople on the platform are independent contractors. They are not employees, agents, or representatives of TradeLink.
2. Our Facilitation Service
2.1 When you post a job on TradeLink, we will match you with available, relevant tradespeople based on your requirements and location.
2.2 You are solely responsible for evaluating and selecting a tradesperson, reviewing their profile and ratings, and deciding whether to enter into an agreement with them.
2.3 TradeLink does not verify the quality of work performed, does not guarantee job outcomes, and makes no warranties regarding the conduct or capability of any tradesperson listed on the platform.
2.4 The contract for services is formed directly between you and the tradesperson you select. TradeLink is not a party to that contract.
3. Payments & Escrow
3.1 All payments must be made through the TradeLink platform. Payments are processed securely via Stripe and held in escrow until you confirm job completion.
3.2 TradeLink's responsibility is limited to the processing and release of funds in accordance with job status. We are not liable for disputes relating to the quality, scope, or outcome of any services.
3.3 Off-platform payments are strictly prohibited. TradeLink accepts no liability for payments made outside the platform, and accounts found to have transacted off-platform may be permanently removed.
4. Disputes
4.1 If a dispute arises with a tradesperson, you should first attempt to resolve it through the in-app messaging system.
4.2 TradeLink may, at its sole discretion, assist in resolving disputes and making decisions regarding escrow release. Any such decision is final.
4.3 Your primary rights of redress for poor workmanship or breach of service contract are against the tradesperson directly, not TradeLink.
5. Your Statutory Rights
5.1 Nothing in this Agreement affects your statutory rights as a consumer under Irish law, including the Consumer Rights Act 2022 and the Sale of Goods and Supply of Services Act 1980.
5.2 These Terms do not exclude or limit any rights you cannot waive by law.
6. Cancellation
6.1 You may cancel a job at any time prior to a tradesperson being assigned, at no cost.
6.2 Cancellations after a tradesperson has been assigned may be subject to a cancellation fee as displayed in-app at the time of cancellation.
6.3 You have the right to cancel your TradeLink account at any time by contacting us or through Account Settings.
7. Reviews
7.1 Following job completion, you may leave a review of the tradesperson. Reviews must be honest, based on your own experience, and must not contain offensive, discriminatory, or unlawful content.
7.2 TradeLink reserves the right to remove reviews that violate these guidelines and to restrict accounts in repeated breach.
8. Your Obligations
By using TradeLink you agree to:
8.1 Provide accurate and complete registration information and keep it up to date.
8.2 Use the platform lawfully and in good faith, in compliance with Irish and EU law.
8.3 Not post misleading, fraudulent, or abusive job requests.
8.4 Not attempt to contact or transact with tradespeople outside the platform having found them through TradeLink.
8.5 Not re-register following an account suspension or ban.
9. No Warranty
The platform is provided "as is" and "as available." TradeLink disclaims all implied warranties to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free access to the platform.
10. Limitation of Liability
10.1 To the fullest extent permitted by Irish law, TradeLink shall not be liable for any indirect, consequential, special, incidental, or punitive damages arising from your use of the platform.
10.2 TradeLink's total liability to you shall not exceed the value of the transaction directly in dispute.
10.3 Nothing in this Agreement limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
11. Indemnification
You agree to indemnify and hold harmless TradeLink, its directors, officers, and employees from any claims, losses, costs, or expenses (including legal fees) arising from your use of the platform, your breach of this Agreement, or your conduct toward other users.
12. Data Protection
Your personal data is processed in accordance with our Privacy Policy, in full compliance with GDPR and the Data Protection Acts 1988–2018. By creating an account, you consent to data processing as described in our Privacy Policy at tradelink-app.com/privacy.
13. Complaints
If you have a complaint about our service, please contact us at support@tradelink-app.com. We will acknowledge all complaints within 2 business days and aim to resolve them within 7 business days.
14. Account Suspension
14.1 TradeLink may suspend or permanently remove any account where a user has breached this Agreement, provided false information, or acted in a manner detrimental to other users or the platform.
14.2 Where reasonably practicable, we will provide a statement of reasons before taking action.
15. General
15.1 Severability — If any clause is found invalid or unenforceable, the remaining terms continue in full force.
15.2 Waiver — Failure to enforce any provision at any time does not waive our right to enforce it later.
15.3 Changes — We may update these Terms at any time with notice. Continued use constitutes acceptance.
15.4 Assignment — TradeLink may transfer its rights under this Agreement to another organisation. You may not transfer your rights without our written consent.
15.5 Governing Law — This Agreement is governed by Irish law. All disputes are subject to the exclusive jurisdiction of the Irish courts.
